Privacy notice

Principles for processing personal data when you send an enquiry through a form on our website. Effective from 29 October 2026.

This document explains how our real estate agency processes the personal data you provide to us through the forms on the website www.bergreal.sk, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Slovak Act No. 18/2018 Coll. on the protection of personal data.

1. Controller

The controller, which determines the purposes and means of processing personal data, is:

We have not appointed a data protection officer (DPO). In all matters relating to the protection of personal data, you can contact us at the email address above.

2. What personal data we process

When you send an enquiry through a form, we process the data you provide to us yourself, in particular:

  • your first name and surname,
  • your email address,
  • your phone number, if you provide it,
  • details of your request (for example whether you are interested in buying, selling or renting, the type and location of the property, your price expectations),
  • the content of your message and any other data you choose to include in it,
  • technical data about the submission (for example IP address, date and time), if recorded.

We recommend that you do not include sensitive personal data in your first message beyond what is necessary to handle your request.

3. Purposes of processing

  • handling and answering your enquiry and communicating with you,
  • brokering the purchase, sale or rental of a property according to your request,
  • taking pre-contractual steps and, where applicable, concluding and performing a brokerage agreement,
  • complying with our legal obligations,
  • protecting our rights and legitimate interests, for example when establishing or defending legal claims.

4. Legal basis for processing

  • Art. 6(1)(a) GDPR (the consent you give by submitting the form, which you can withdraw at any time),
  • Art. 6(1)(b) GDPR (pre-contractual relations or the performance of a brokerage agreement),
  • Art. 6(1)(c) GDPR (compliance with our legal obligations, in particular under Slovak Act No. 297/2008 Coll. on protection against money laundering and terrorist financing, as a real estate agency is an obliged entity, and under accounting regulations),
  • Art. 6(1)(f) GDPR (our legitimate interest in keeping records of communication and protecting legal claims).

5. Retention period

We keep personal data only for as long as necessary to achieve the purposes above. If the enquiry does not lead to further cooperation, we generally keep the data for no longer than 5 years from our last communication and then delete it. If we broker a transaction, we keep the data for the duration of the relationship and then for the period required by specific regulations. Data and documents obtained in fulfilling our obligations under Act No. 297/2008 Coll. are kept for 5 years, as that Act requires.

6. Recipients of personal data

We do not share your personal data with third parties for marketing purposes without your consent. It may be made available to:

  • the provider of the web hosting and server services through which the website is operated,
  • the provider of the email services we use for communication,
  • cooperating persons where necessary to handle your request (for example a mortgage specialist or a notary), always only to the extent necessary and with your knowledge,
  • public authorities where a legal regulation requires us to do so.

Our processors are bound by a data processing agreement and a duty of confidentiality.

7. Transfers to third countries

We generally do not transfer personal data to countries outside the European Economic Area. Should such a transfer take place, we will ensure appropriate safeguards for it in accordance with the GDPR.

8. Cookies

This website uses cookies that are necessary for it to work properly, which we process on the basis of our legitimate interest. If the website uses analytics or marketing cookies, it uses them only with your consent, which you can withdraw at any time.

9. Automated decision-making and profiling

Processing the data from the form does not involve automated decision-making or profiling that would have legal effects on you or similarly significantly affect you.

10. Your rights

In connection with the processing of your personal data, you have the right to:

  • access your data (Art. 15 GDPR),
  • rectification of inaccurate data (Art. 16),
  • erasure, the so-called right to be forgotten (Art. 17),
  • restriction of processing (Art. 18),
  • data portability (Art. 20),
  • object to processing (Art. 21),
  • withdraw your consent at any time (Art. 7(3)), without affecting the lawfulness of processing before its withdrawal,
  • lodge a complaint with a supervisory authority.

11. Voluntary provision of data

Providing personal data is voluntary. However, without the data marked as mandatory (usually your name, email and the content of your message), we cannot process and answer your enquiry.

We may update these principles from time to time. The current version is always available on this page together with the effective date stated at the beginning.
